The Many Areas of Legal Research & Practice

Law is a formal system of rules developed and administered by governmental or communal bodies to govern behavior, often with an emphasis on individual liberty and its rights protected by the law. It has, in different ways, been differentially defined as the art and science of civil law. In particular, it is concerned with the interests of the individual who claims entitlement to a public remedy, whether that entitlement is legal or equitable. The law is the body of knowledge with respect to all subjects relating to legality, morality, legitimacy and legality. Its object is to secure the interests of individuals, groups and associations while protecting their rights, duties and privileges.


Law is the discipline of knowledge and of practice concerning all subjects relating to the administration of justice, including private law, civil law, criminal law, administrative law, family law and international law. The area of law is complex, because it attempts to address many different issues of significance to man. All laws attempt to create just conditions under which a person may satisfy the necessities of life, but there are also other considerations such as coercion, incapacitation and consent. There are three different perspectives on the development of law.


One way to make law within society is through legislation. Legislation is the adoption of laws by a majority of members of a legislature, for the execution of the laws. Legislation exists because people have a legal capacity to adopt laws and because they must defend those laws against the opposition of other persons. However, in order for laws to be implemented, members of the legislature must ensure that the laws are not arbitrary, and that they are apt for the existing circumstances and situations and for the benefit of society as a whole. In addition, the members of the legislature must ensure that the laws are reasonable and proportional to the impact they will have on the general interest of the state.


Another way to make law within a legal system is through appeal. Appeal is the collective decision of the legal system's judges to the higher court of appeal. The judges review the facts in a case in order to determine whether there is a reasonable doubt as to the guilt or innocence of a party. If there is reasonable doubt in the legal system, then the party appealing the verdict must demonstrate that there is an exception to the rule established by the judge. If the higher court of appeal agrees that there is a reasonable doubt in relation to the guilt or innocence of the accused, then the party appealing the verdict must produce documentary evidence to support their argument.


Constitutional law is the body of law which governs the constitution and structure of the American government. Constitutional law is the supreme law of the land and it applies to all Americans, regardless of their birth place. Constitutional law is divided into two branches: the federal law and state law. The branches work together in protecting the constitutional rights of all American citizens.


A third branch of law within society is known as civil law. This type of law deals with disputes between private parties regarding their legal rights and obligations. Civil law includes but is not limited to: common law, maritime law, probate law, family law, divorce law, criminal law, and proprietary law. Civil law is the source from which most American Citizens feel they can draw legal assistance when they encounter legal issues. Common law is the body of law established in our nation's Constitution and laws codified in our nation's federal and state laws. Maritime law involves maritime matters, such as maritime accidents, admiralty law, and commercial law.


The fourth branch of law is known as corporate law. Corporate law is the body of law governing the relationships between individuals and organizations. There are three branches: property, corporations, and partnerships. In property-based law, corporations and individuals to own real estate, businesses, and other property. In partnership-based law, businesses share resources and assets.
